What It Is

What It Covers

Typical claims that fall under professional liability include:

  • A client claims a treatment (laser, injectables, chemical peel, microneedling, etc.) caused burns, scarring, infection, or pigmentation issues
  • A patient asserts that the results were not as promised (unsatisfactory outcome)
  • Missed diagnosis or failure to screen contraindications
  • Allegations of incorrect technique, poor judgment, or omitted warnings
  • Inadequate documentation, consent forms, or breach of standard of care

Who It Protects

  • Your business entity (your med spa)
  • The individual providers (e.g. physicians, nurse practitioners, aestheticians)
  • The medical director (for supervising, consultation, or direct care duties)

Claims-Made vs. Occurrence

Most professional liability policies (including ours) are claims-made. This means:

  • A claim is only covered if both the incident and the reporting of the claim occur while the policy is active
  • If you cancel or let your policy lapse, you may lose protection unless you purchase a tail (extended reporting endorsement)
  • Occurrence policies (rare ones in this space) cover any incident occurring in the policy period—even if reported later—but they typically cost much more

Gaps & Common Pitfalls

  • Your doctor’s personal malpractice may not cover your med spa as an entity or other staff members
  • Independent contractors/providers might not be covered by default (you’ll need endorsements or named insureds)
  • If you expand services (e.g. add lasers, injectables, hormone treatments), your existing policy may not automatically include these
  • Failure to maintain proper documentation, consents, and protocols can undermine your defense

General Liability

What It Is
General liability insurance (often called Commercial General Liability, or CGL) protects you against third-party claims for bodily injury, property damage, or advertising injury that occur during the course of regular operations — regardless of whether you were performing a medical or aesthetic procedure.

What It Covers (Examples)

  • A client slips and falls in your waiting room or reception area
  • A piece of client property is damaged (e.g. phone dropped by staff, spilled drink)
  • Advertising claims, defamation, or incorrect marketing statements
  • Some policies include product liability (if you sell skincare products that injure a client)
  • Legal fees, settlements, or judgments arising from such incidents

What It Doesn’t Cover
Crucially, general liability does not typically cover claims arising from the professional services or treatments you perform – that’s what professional liability is for. So if a treatment itself causes harm or is alleged to have failed, general liability often excludes it.


 

Myths & Misconceptions You Should Bust

  • “My doctor’s malpractice covers the entire spa.” — Often false. Many medical malpractice policies exclude “outside entities,” meaning your spa (and staff) may be unprotected.
  • “My landlord’s or building’s liability covers me.” — Usually not. Their coverage is for their operations, not yours. You need your own general liability.
  • “I don’t need tail coverage; I’ll just reapply later.” — That’s risky. Without tail protection, claims filed after your policy ends might not be covered.
  • “I only do noninvasive treatments; I’m safe.” — Even “noninvasive” services carry risks (e.g. allergic reaction, pigmentation issues, burns).
  • “I don’t need both policies; one is enough.” — Wrong. Each policy covers different types of risk; skipping one leaves a gap.
